摘要
在限权条款中规定公正补偿原则是民主宪政国家的通例。但是何谓公正补偿,在理论和实践中存在不同的认识。文章将各国公正补偿原则的类型进行分类,并且对于其之所以被认为公正的理由进行探悉。在此基础上,揭示了公正补偿原则内涵和外延的时代性和社会功能,并提出完善我国补偿原则的立法建议。
Almost every democratic constitutional country formulates the principle of just compensation. But what does the principle of just compensation mean？ There are different attitude in theory and practice. Firstly the article categorizes many kinds of principles ,which are regarded as just compensation principle and analyzes the reason. Then it changes analysis perspective into function perspective and provide some propositions for the compensation principle in our country.
