摘要
法律技术是法学方法论体系中,围绕法律的适用所产生的技能、手段,它不同于法学研究方法,也无法涵盖法学方法论的全部内容。法律技术是传统性与正当性相结合、理性和经验相统一的具有专业性的法律适用方法和手段,既具有科学的特质,又体现人文的精神。在法律技术的范围上,可以分为“文本分析技术”、“事实发现技术”及“法律适用技术”三个层面。
Legal techniques include skills and measures that are developed while applying laws within the system of legal methodology. Legal techniques differ from legal research methods. They cannot cover all the contents of legal methodology. Legal techniques are specific legal application skills and measures, which proves to be the combination of tradition and justification, and rationale and experience. They embody the scientific elements and humanistic spirits and from the angle of legal techniques can be divided into ＂text-analysis skill,＂ ＂fact-finding skill＂ and ＂law-application skill. ＂
