摘要
容隐制在中国法律传统中有着深厚的社会基础和悠久的历史。“构建社会主义和谐社会”是我党在现代社会提出的一个新命题。文章在回顾容隐制历史沿革的基础上,从人性、社会环境等多个角度对该制度在和谐社会建设中的合理性进行了剖析,并且从我国现行立法的角度,简要论述了和谐社会中容隐制的构建。
The system of misprision of treason, which has a deep social base and a long history, is a typical system in our ancient society. It is a new concept to construct the socialist harmonious society. This article expounds the construction of this system based on the history of it, from the angle of human nature and social atmosphere, considering the present legislation.
