摘要
经济法的功能实现是建立在以民商法为基础的市场经济条件下的,它表现为对民商法张扬的权利的限制和对国家干预经济权力的规范,以确保权利实现的公平环境,维护市场竞争秩序。经济法功能实现的基础体现在市场经济的自身缺陷和民商法对市场经济自身缺陷的克服存在的局限。
The realization of economic law＇s functions is established under the market economic environment based on civil ＆ commercial law in a way of restricting the publicizing of civil ＆ commercial law and regularizing the right of state intervention in economy. It has the inbred limit on overcoming the disadvantages of market economy, which leads to a fair environment to realize rights and preserve a normal competitive system. The base for the realization of economic law＇s functions exist in the market economy＇s own faults and the limitation of civil ＆ commercial law in the process of overcoming the market economy＇s faults.
