摘要
警察权主要有两大职权,即警察行政职权和警察刑事职权。警察权的本质是行政权。对警察权本质的分歧,主要在于侦查权的性质。无论是从侦查主体、侦查程序的运作、侦查的价值和功能方面看,侦查权都应归属行政权。
The powers of the police include the administrative powers and criminal powers. The essence of the powers of the police is the administrative powers. The difference of it lies on the investigation powers. No matter from the view of the body of the investigation or the value and function of it, the powers of the investigation have the obvious characteristics of the administrative powers.
