摘要
企业社会责任在20世纪80年代重提并成为一个全球性的社会运动,其法律背景主要表现为所有权与生存权在全球化过程中的深刻冲突。企业社会责任运动以及其具体形式的“企业生产守则运动”,正是在全球化背景下,为协调劳资关系、保障劳工的生存权而形成的一种社会行动。企业的社会责任,就其本质而言是指企业对于社会所应承担的法律责任,就其责任范围而言,则主要是指对于企业内部劳动关系调整和劳工权益的实现所应承担的责任。企业社会责任的法律性质,决定了这一运动并非只是改善劳动者的“利益”,而是要实现劳动者在企业生产过程中的“权利”。因而,在企业社会责任的实施中,要防止雇主企图通过“企业生产守则”来实现对于工人的控制和对于传统劳工运动的替代或排斥的倾向。为保证企业社会责任的健康发展,必须将企业社会责任纳入劳动法制轨道。
This paper argues that the corporate social responsibilities (CSR) were mentioned again and developed into a global social movement during 1980s, whose legal background manifests itself in the serious conflict between the rights of ownership and survival under globalization. It is under this global background that the Movement of CSR, along with its specific "workplace code of conduct", becomes a social action for coordinating the capital - labor relationship and protecting the workers' right of survival. CSR with regard to their intrinsic character refer to the legal responsibilities that enterprises should take towards the society, while the confines of their responsibilities mainly include the responsibilities for adjusting internal labor relations and realizing the rights and interests of the laborers. The legal character of CSR determines that this movement is intended not only to improve the workers' "interests" but also to endeavor to realize laborers' "rights" during enterprises' production processes. Therefore, with CSR being fulfilled, it is necessary to prevent the corporate employers from making any attempts to control the workers, and to replace or exclude the traditional labor movement by utilizing "workplace code of conduct". CSR should be integrated into the labor law in order to guarantee their healthy development.
