摘要
社会保障权既是一项基本人权,也是一项宪法权利。受社会生产相对落后以及原有二元社会制度的影响,农民工的社会保障权现状堪忧。社会保障立法缺失导致农民工社会保障权的缺失;社会保障制度不完善,致使农民工无法享受相关权利。要使农民工实现社会保障权,必须从立法、行政以及国家履行积极义务等几个方面采取措施。
Social safeguard right is a fundamental right granted by the constitution. The current situation of peasant laborers＇ social safeguard right is not satisfactory due to the backwardness of social production and the dual social system. Defect of social safeguard legislation leads to being wanting in peasant laborers＇ social safeguard right. It is necessary to ensure peasant laborers＇ social safeguard right from following aspects-legislation, administration and the state＇s performing the duty.
