摘要
国家赔偿法的实施几近陷入被称为“国家不赔法”的尴尬境地。究其原因,是多方面的,包括赔偿法制度设计本身的问题,还包括经济发展水平、法治观念、执法环境等因素。其中,在当初立法时并没有重视,学术研究中也往往被忽视,但却成为国家赔偿法顺利实施梗阻的是赔偿经费问题。修改国家赔偿法,必须对赔偿经费的设立、管理与支付制度作出重新设计。
The implement of funds for state compensation has almost landed in an awkward predicament of no compensation by the state. The causes are many - sided, which include the design of compensation law system, economical development level, concept of legality and enforcement and etc. Among them, the compensation funds, which the legislators did not attach importance to and the academic research ignored, has been an obstacle for implementing the state compensation law. To amend the state compensation law, we must re- design the establishment, regulation and payment system of compensation funds.
