摘要
我国用益物权制度的本土化,体现在对我国发展中将长期面临的三大因素作出相应的制度安排上。首先是财产类型的变化,据此,动产不应作为用益物权的客体,应当规定各种特许物权并引入地役权和人役权。其次是土地的公有制,其与市场经济体制之间的矛盾决定了应当强化建设用地使用权、农村土地承包经营权以及宅基地使用权等独立性用益物权的效力,使之成为"类似所有权"的权利,从而能够进入市场流转。第三是长期、大规模人口流动和城市化进程,这要求允许农村土地权利自由流转。
Localization of Nutzungsrechte in Property Law of China is based on how to deal with three problems being confronted with. First, the changing of property types. Hereby, movables can' t be the object of Nutzungsrechte. Privileges to mining , hunting and halieutics should be regulated in the Property Law, also Servitutes praediorum and Servitutes personarum. Secondly, land can only be owned by public. The contradiction between Land Public-Ownership and market economy system determines that the effectiveness of Emphyteusis and Erbbaurecht should be strengthened and be turn into a right as ownership so as to be transferred in market. Thirdly, the large-scale population flowing and urbanization require to permit peasants to sale their Emphyteusis and Erbbaurecht freely.
