摘要
中国传统法律文化中的无讼及调解制度,有其合理的因素,我们应在批判继承的基础上实现中国传统法律文化的创造性转化,一方面是为了保存其价值的永恒的成分;另一方面是为了不断地自我完善,建设现代化的法治国家。
Tradition contains the factor of modernity ; for this reason, in process of legal modernization, we should hold the attitude of a kind of judgment to the dealing of legal tradition. This article analysed Chinese traditional legal culturenon-litigation and mediation system, from the modern angle, and affirmed the reasonable factor involved in this process for the purpose of realizing the creative transformation of Chinese traditional legal culture.
