摘要
侦查主体与侦查客体关系问题是侦查学的基本问题。这一问题存在的依据在于:侦查主体与侦查客体关系问题贯穿侦查学发展过程的始终,标志着侦查学的研究对象和侦查学理论的特珠性质,表现着侦查学理论的特有认识方式和侦查活动一般规律的问题;侦查学的基本问题被侦查活动历史所证明;侦查主体与侦查客体利益矛盾和冲突是构成侦查学基本问题的根本原因;侦查主体与侦查客体关系问题的解决,决定侦查活动其他问题的解决。
the relationship between subject and object of criminal investigation is considered as a basic problem of criminal investigation in the ground that this problem is the clue of development procession of criminal investigation; it signals the object of study and special nature of theory on criminal investigation; it reflects a specific means of understanding to investigation and general principle of investigative activities. The basic issue of criminal investigation has been proved by investigative progress. The main reason for this basic issue lies in the conflicts between the subject and the object. To solve this problem play a decisive role in solving other investigative problems.
