摘要
运用违法行为的可紧急避险性和可安全回避性规律,对违法行为的不同预见程度在事故中所起作用进行了探讨,在此基础上,构建了违法行为可预见性的分析模式,为认定交通事故责任提供了更为可靠的理论依据。
By using the regularities of the avoidable possibility from danger and the avoidable possibility for security,this article discusses the role that different foresighted degrees of the illegal activity played in the accident, and on the basis of it,it constructs the analyzing patterns of the foresighted possibility for the illegal activity,which provides more reliable theory foundation for the traffic accident responsibility recognized.
