摘要
通过讨论农村集体土地发展权在征地过程中没有得到全面认可的现状,指出土地征用中尤其是公共利益性质征地行为对土地发展权的侵害现象,分析了在土地征用中不考虑集体土地发展权对农民进行低价补偿以及带来的负面影响,并在此基础上提出了对发展权补偿的几条建议。
The paper discusses the problem of the development rights for rural collective land not being completely recognized in the process of land expropriation, pointing out that land expropriation, especially that for the common benefit has imposed harm on the land development rights. The paper also analyzes the negative influence caused by low cost compensation in land expropriation and offers some suggestions for the compensation of land development rights.
