摘要
自由心证与证据规则相结合,代表了当今世界各国证据制度发展的潮流,我国的证据制度应采自由心证与证据规则结合的证明模式。在证据证明力的判断上,应采自由心证原则,证据规则应以规范证据能力为主,例外场合可对证明力作出直接规定。我国应制定统一的证据规则,从而保障法官形成合理的和科学的心证。
This paper represents the tendency of the development of system of evidence in the world that the combination of discretional evaluation of evidence and rules of evidence which we should adopt. Free evaluation of evidence through inner conviction should embody in the weigh of evidence. The rule of evidence should be superior in numbers in the rules of evidence which prescribe probative force with the exceptional circumstances. Uniform rules of evidence in our country will benefit for forming rational and scientific inner conviction.
