专利的垄断性与排他性有其存在的合理原因。为保证专利授予后市场安全,从专利授予中对新颖性、创造性、实用性三方面进行严格限制。鉴于专利的排他性,对专利在工业化运用中的限制,排除不正当竞争等方面,防止专利权利的滥用。
It is reasonable that patent has monopoly and exclusive fight. To ensure that the market is safe after patent granted. The manner is to be strict to its novelty.productivity, as well as practical. What＇s more ,jn view of exclusive, we have to restrict its exercise in the industrialization to eliminate the illegal competition.
