摘要
文章在分析了起点公平、规则(过程)公平和结果公平的缺陷后,对几种公平进行了整合,提出了一种基于制度主义的统合公平观。统合公平观认为,公平应在基于非歧视的规则约束下,来保障过程公平,并在可行的范围内去调整结果失衡和缩小起点差异,从而使社会分配收敛于结果公平。
This paper analyzes the disfigurements of initial justice, inerratic justice and consequential justice, and advances a unified justice based on institutionalism. Unified justice holds that justice should be pursued under the restriction of institutions, aiming at process justice, regulating consequential unbalance and lessening initial discrepancy; as a result, social distribution will be constringent to consequential justice. Furthermore, it studies the essentials of opportunity justice and proportion justice in reference to unified justice.
