摘要
土地买卖是清代、民国时期农村普遍存在的社会现象,土地买卖契约是地权转移的重要凭证。考察束鹿县张氏家族土地买卖契约,可以看出：其订立符合现代合同成立的基本要素,其条款符合现代合同格式条款的基本特征,其法律效力为当时国家政权所承认,体现了现代契约精神。
Land deal was once a common social phenomenon in the countryside of central Hebei during the Qing Dynasty and the Republic of China . It is the important evidence in support of the transmissions of land ownership. It can be seen from the deeds of land deal given by the Zhang family in Shulu county. The deeds the family had made conformed to the essential factors of making modem contracts and to the fundamental features of the form of clauses in modem contracts. The law authenticity of the deeds was admitted by the government at that time. As a result, the land deals in the countryside of Central Hebei during the Qing Dynasty and the Republic of China reflected the spirit of making deeds freely in modern time.
