摘要
同为侵权责任构成要件体系中的过错与因果关系,因功能之耦合,在侵权责任认定中难免会被交叉运用。应从侵权责任构成要件的内涵入手,来考察过错与因果关系的功能耦合及过错对因果关系认定的影响,并对二者在侵权责任认定中相结合的路径进行认真地思考。
In a system, the fault and causality of the components of the liability for tort, because of the coupling of the function, will be used alternately in the recognition of the liability for tort. We should start with the meaning of the components of the liability for tort, investigate the functional coupling of the fault and causality and the fault influence on causality recognition, and ponder over the route where the two combine together in the recognition of the liability for tort conscientiously.
