摘要
犯罪构成理论被誉为刑法学王冠上的宝石,是公正定罪目标实现的重要保证。我国传统犯罪构成理论具有缺陷,对其所进行的反思一直持续地进行着。王志远博士的《犯罪成立理论原理——前序性研究》一书以“如何构建最有利于定罪公正的定罪思维模式”为中心,对我国传统犯罪构成理论的立体化重构这一论点进行了全新的论证。但是该书在正确认识犯罪构成理论在公正定罪实现过程中的作用等问题上仍值得反思。
Criminal Constitute Theory is an important assurance of Realization of Impartially Conviction, so that it is always deemed as precious stone on the Crown of criminal law. There are some limitations on the traditional Criminal Constitute Theory of our country, and the reconsideration is keeping on. Dr Wang zhiyuan°φs new book which named°± Research on Premise of Cascading Criminal Constitute Theory°± focus on the problem of °∞how to construct a rational thinking method for conviction°±, argue that we must have to reconstruct the Criminal Constitute Theory from the plain to Cascading one, and his demonstrate is newly. But we have to say there still are some questions deserving reconsideration.
