摘要
诉讼行为是构成诉讼活动的基本要素之一,也是实现诉讼程序价值和目的的基本载体。没有诉讼行为,也就不存在所谓的诉讼和司法过程;诉讼行为贯穿于诉讼活动的始终。在分析法律行为的基础上,对诉讼行为的含义、特征、构成要件及其分类等进行了分析,并对影响认定诉讼行为的因素进行了探讨。
The litigation action is one of the key elements forming the litigation procedure, and it is the basic carrier to achieve the ligitation＇ s value and aim. If there is no litigation action, there is also no so-called litigation or the judicatory process either. Litigation action runs through the litigation activity. Based on an analysis of the legal action, the meaning, characteristics, constituents and classification of litigation action as well are analysed and the influencing factors for the assertion of a litigation action are also discussed.
