摘要
近年来,有关驰名商标保护的立法在国际和国内逐步完善,对驰名商标的保护可谓密不透风,但驰名商标在认定和使用中专用权被滥用的现象却没有得到足够的重视。本文在列举驰名商标权利滥用种种表现的基础上,对驰名商标的权利滥用规制从立法和执法上提出对策和建议。
In recent years,the legislation of the protection of famous trademark are becoming more and more perfect,but the abuse of famous trademark is not paid enough atten-tion.After analyzing different cases of abusing famous trademark,the paper gives some suggestions about its legal regulation and judicial practice.
