摘要
他山之石,可以攻玉。奥地利《行政罚法》相对我国《行政处罚法》来说较为完备、系统,特别是该法在适用效力、管辖权的竞合、简易程序的适用条件、处罚的裁量及执行等方面的立法更为细致周全,且有较强的操作性。因此,有必要借鉴奥地利的行政处罚立法,对我国《行政处罚法》予以修订和完善。
