摘要
土地使用权划拨作为国有土地有偿使用制度的补充形式,在我国仍然存在。在法律上对划拨土地使用权的有关问题予以关注,主张在处理划拨土地使用权问题上,既要保护土地使用权人的利益,同时又要兼顾土地所有权人的利益。
The right to the land-use of which is allocated by the State is a kind of complement form that still exists in the system of compensated use of State-owned land in our country. This thesis gives a concern to the problem that is relevant to the allocated Land-Use Right on the law, and stands for giving consideration to the benefits of both sides of the Owner and the user on handling the allocated Land.
