摘要
当代中国农民的根本问题已经凸显为以“平等权”为核心的权利问题。农民平等权是构建和谐社会秩序的基石和保障,也是社会发展、农民自身解放的一个必要条件。当代中国农民平等权利的保障和实现不同程度地受到了旧体制的制约,有的甚至还存在法律的盲区。深入探讨农民平等权的法理依据,透析我国农民平等权保护的现状,进而寻求促进和保障实现农民平等权的对策,对实现农村法治,保障整个社会和谐稳定发展具有重大意义。
The key problems of peasants in China today have been become problems of right centering on equal right. Equal rights of peasants are rite comerstone and safeguard of constructing harmonious society, and it is a prerequisite to secial development and peasants liberation by themselves. Safeguard and realization of Equal Rights of Peasants in China today is restricted to some extent by old system, and some exist blind area of law. Probing into foundation of the theory of law on equal rights of peasants, Analyzing the present situation of protection of equal rights of peasants in China today thoroughly, and exploring eountermea.sures of promotion and safeguard of equal rights of peasants, which has great significance for realization of rule by law in the countryside and safeguard of stable and harmonious development of the whole society.
