摘要
我国虽确立了监狱企业体制改革的基本方向，但在具体管理模式上仍存在很大争议。比如体制内模式是公营市场化体制还是政府使用制；在体制外模式上是否允许民间介入罪犯劳动生产、如何运作等等。由于目前我国单一的公营市场化模式在市场经济体制下面临诸多困境，不少人主张采用单一的政府使用制代替目前的公营市场化体制。笔者认为，无论是单一的公营市场化模式还是政府使用制都各有其缺陷。必须通过体制改革，完善相关法律制度，建立体制内、外兼具互补的监狱企业管理模式。
Although our country had established the basic direction of the structure reform of jail enterprise management, there is still a very great dispute in the concrete management pattern. For instance, inside the system, whether the pattern is the public-operated marketability system or government uses it; outside the system, whether allows the folk to involve the criminal labor production or how to operate it, and so on. At present, under the market economy system, because our sole public-operated marketability pattern faces so many difficulties, a few people advocate to replace the public-operated marketability system with that of sole government using. The author believes that both of them have its flaw, we must establish the jail business management pattern through the structure reform to make them consummate each other.
