摘要
我们无法摆脱传统诉讼文化对当下法治建设的影响。乡土社会中的刑名师爷是案件的真正决断者,是法律职业者,但他们的社会地位十分低下,处于政治和道德上被双重拒绝的困境,这恰与发轫于西方的现代法治理念和现实形成鲜明的对比。借古思今,以制度化的方式提升法律职业者的地位,仍然是我们努力的方向。
The current reform of litigation system is destined to be affected by traditional cultures. Legal secretaries for the official were the real experts in our traditional society. But their social status was very low. These have little similarity with modem judicial theory and practice that comes form the West. Raising the social status of the concemed with system construction is still the important thing that we should do today.
