信访制度之进退——对信访机构功能定位的思考 被引量:13

摘要 近年来,信访问题日益成为我国一项重要的社会问题,围绕着如何恰当定位信访机构所应发挥的功能,如何妥善处理、化解信访事项、信访矛盾,存在着不同的建议、表述和实践,本文就此在分析了信访制度之进退的两种思路之后,认为随着2005年年初新的《信访条例》的颁布,中国的信访制度应在继续完善法制化的基础上迈向法治化。 In recent years the problem of correspondence and visitation becomes a central social issue in our country. How to properly define the function of the correspondence and visitation organization? And how to appropriately deal with and resolve the conflict of letters and calls? It is being expressed by different viewpoints and practices. Basing on the analysis to the two thoughts about the advance and retreat of the correspondence and visitation system, this thesis presents that with the promulgation of the reguation on letters and calls on January 10,2005, the correspondence and visitation system should step by step toward the rule of law on the foundation of accomplishing the institution construction.
