摘要
韩国总统弹劾案生动地体现了宪法与政治之间的密切联系。宪法虽然以规范政治主体行为为首要任务,但从实践中考察,宪法产生于政治冲突,并且在政治冲突中得到检验、发展和完善。宪法确立的民主宪政体制是国家政治稳定的前提,社会成员特别是国家领导人法治观念是实现国家政治稳定的核心,而全体社会成员对民主、自由的追求则是政治向前发展的根本动力。
The case of the impeachment of president of Korea embodied the intimate relationship between the Constitution and the politics. The Constitution puts the standardization of action of the body of the politics on the first place, but in actual, the Constitution is brought from the political struggle, examined and developed in the political conflict. The establishment of democracy framework by the Constitution is the precondition for the stabilization of the society. The whole society especially the leaders of the nation should enhance the idea of the rule of the law, which is the core to realize the national stabilization. And the pursuit of the democracy and freedom by all the people is the power to push the development of the politics.
