摘要
本文以农村集体建设用地使用权流转作为探讨视角,在全面阐述中国农村集体建设用地使用权流转的立法现状及实际运行情况的基础上,提出现有农村土地产权制度的缺陷是束缚集体建设用地使用权流转的根本原因,并进一步从产权角度提出完善农村集体建设用地使用权流转的建议。
From the view of transferences of usufruct of rural collective construction land, and on the basis of legislation and practice situation, this paper indicates that the shortcomings of property right system of rural land is the basic reason restricting transferences of usufruct of rural collective construction land. Suggestions on usufruct transferences perfections of rural collective construction land are put forward from the property right in this paper as well.
