摘要
“制度事实”是麦考密克及魏因贝格尔“制度法论”的基本概念。通过对构成麦考密克及魏因贝格尔“制度法论”的基石概念“制度事实”较为深入的探析。作者提出:法律制度是一种不同于自然物的“异在”;“制度事实”可知可控。
Institutional fact is a foundation concept of Maccormick and Weinbergerg institutional theory of law. In this paper, new points of view that the legal system is a kind of alienation different from the nature and our cognitive ability and power can control the institutional fact are proposed.
