摘要
文章认为民歌是音乐创作的自然资源。它就像那埋在土里的具有灵气的树根、埋在河床的具有灵气的石头,谁独具慧眼,谁就是它的主人。据此,作者对王洛宾和郭颂因民歌著作权问题受到的责问乃至诉讼表示了自己的看法,对甘肃青海两省重视朱仲禄表示赞赏。并就有关人士对《著作权法》个别条文的释义提出了不同意见。
The author of the paper holds such a belief that folk songs are the natural resources of musical creation. Like the tree roots buried beneath the earth and the stones under the fiver bed with nimbus, these resources belong lawfully to the discoverer who found them with special eyes and insights. The author thus presents his own point of view to the cases of authorship with which Wang Luo-bing and Guo Song were brought to account even legal action. Meanwhile, the author expresses his appreciation to the authorities as well as common people in Gansu and Qinghai for their positive attitudes to Zhu Zhong-lu and puts forward disagreement to the paraphrases some individuals indicated for the specific clauses concerning Copyright Law.
