摘要
城市土地租赁日渐成为我国重要的土地有偿使用方式。明确界定城市土地租赁的内涵,使其区分于极易混淆的土地使用权租赁,明晰城市土地租赁中的权利构造,另一方面,合理地确定租金数额,使国家的土地所有权在经济上得到实现,在顾及到土地使用者承受能力的同时实现国家利用租金对土地市场进行宏观调控,乃当务之急。
Urban land rental has become an increasingly important mode of compensatory land use in China. It is necessary to define its connotation, discriminate between it and land servitude rental, which are easily confused, clarify the rights construction, and reasonably set the amount of rent. The aim is to realize the state ' s ownership financially and make allowance for the acceptability to land users while accomplishing macroregulation of the land market through rent by the state.
