摘要
美国宪政是人类历史上的重要制度创新,是美国获得长治久安、国力突飞猛进的制度保障。影响美国宪政体制的因素主要有来自英国的普通法传统、殖民地自身的政治经验以及源自欧洲的启蒙思想。在创建新体制的过程中,美国既有对传统的继承,也有对新思想的吸纳,更有对自身经验的总结。
The American constitutionalism is an unprecedented institutional invention in human history. It is the institutional guarantee for the growth and prosperity of the United States. The American constitutionalism was born in specific historical circumstances. The main factors that ever influenced the American constitutionalism are the English common law tradition, the political heritage of the colonies, and thoughts from the Enlightenment. At the time the framers built a new political system, they absorbed the old traditions of their motherland, as well as new political thoughts, and the reflections on the colonies' history. All these elements make the United States take an unique development road which is much different from other nations.
