摘要
孟德斯鸠的三权分立思想受到了英国资产阶级革命实践的影响,直接起源于洛克的三权分立理论,根据现实政治的变化,他重新铸造了三权分立学说,突出了以权力制约权力的根本内涵和价值,产生了深远的影响。本文通过对三权分立学说来源的追溯,分析了它的历史进步性和它的局限性。
Montesquieu＇s separation of powers doctrine （separation of the legislative, executive and judicial powers） originates from Walker＇s separation of powers theory. Under ＇.he influence of the British bourgeois revolution, Montesquieu re-expounded the doctrine of separation of powers according to the politics of that time. In his doctrine, the balance of powers is stressed which has had profound influence on political system theory. This paper discusses the historic progressiveness and the limit of Montesquieu＇s separation of powers doctrine.
