市场运行机制需要制度保障。在市场经济的初级阶段,民商法是保障市场运行的制度基础。随着市场经济的发展和完善,垄断、外部性和社会分配不公正等经济和社会问题阻碍了市场经济的运行。经济法就是为了克服市场经济本身的痼疾而出现的法律部门。
Operational mechanism of market requires institutions. In the primary phases, Civil and Merchant Laws is the foundation of market operational system. With the development of market economy and its improvement, injustice problem of economy and society, such as monopoly, external economies and unjustice social distribution, have held up the operation of market economy. Economy law as a branch of law is overcoming the innate malady of market economy.
