摘要
在法治社会中,权力总是对应着一定的责任。从理论上讲,立法机关同样存在着侵犯公民权益的可能性。从国外的制度比较来看,法国、德国都存在着立法赔偿责任制度。因此有必要探讨我国《国家赔偿法》排除立法赔偿的原因、论证我国纳入立法赔偿制度的可行性。
Any power is also a duty, likely to cause responsibility; the Legislative organs may also infringe upon the people＇s lawful interests, and correspondingly it exists the system of Legislative compensation in French and German. However the State Compensation Law of China excludes such compensation, thus the reasons are examined and the feasibility to establish it is discussed in this article.
