摘要
受教育权是受宪法保护的主体公法性权利,但与学校的行政管理权之间存在着理论与现实的冲突,需要行政法提供全面的保护。基于受教育权行政法保护的请求权基础,我国应当扬弃“特别权力关系”、“学校自治”等传统理论,确立教育行政救济的正当程序、有限审查、合法性审查等基本原则,并重构全面包含行政申诉、行政复议、行政诉讼、行政赔偿的教育行政法保护体系。
As a basic right, the educational right is protected by the Constitutional Law, but it confronts conflicts of the administrational power of school both in the theory and the practice. Therefore, it needs overall protection provided by the Administrational Law. Based on the foundation of the educational right's claim, the traditional theories, such as Special Power Relationship and School Self- regulation, should be developed, and the basic principles of administrative remedy including the due process, the limited review and the legitimacy review, should also be established. And then we can reconstruct the education - administrational remedy system covering administrative complaints, administrative reviews, administrative proceedings and administrative compensation.
