摘要
新交通法自颁布实施后,争论最多的是体现行人及非机动车与机动车发生交通事故归责原则的第76条,本文试从法经济学角度入手,运用经济学最基本的成本-收益理论对严格责任与过错责任的优劣之处进行价值分析,以期对公共制度的选择做出初步的评判。
The newly issued Road Safety Law has taken effect. There are lots of discussion on Article 76,which stipulates the rule for the determination of traffic accident happened between automobile and pedestrian .This paper attempts to do a legal-economic analysis on the value of strict liability and negligence liability by Costs-benefit theory ,which is the fundamental of Legal and Economics in order to give a reasonable judgment to the legislation.
