摘要
第三人利益合同是在开放经济条件下,合同当事人意思自治的产物,有利于保护第三人的利益,实现成本节约,但在合同相对性原则下是不能顺利实现的。分析了第三人利益合同存在的基础,探讨了第三人利益合同的效力,进而提出第三人利益合同的立法建议。
The contract for the benefit to third party is a result with contract party intention. It contributes to protecting the benefits to the third party and realizing cost economy, but it can＇ t be achieved smoothly under the relative principles. The paper analyses the existing base of contract for the benefit to the third party, discusses the efficacy of it , and at last, provides contract legislation for benefit to the third party.
