摘要
法律经济学自诞生之日起就受到了诸多学者的批判。本文从经济学角度出发,对其赖以生存的“经济人”假说与交易费用理论进行了评析,最终目的是为了完善进而重构这一法学流派。
The law economics theory has been criticized by many scholars since it was created. This remarks on the academic basic such as the theory of economic man and dealing expense from the point of view of the economy. The final prupose is to consummate and reconstruct this theory.
