摘要
中国房地产市场在快速兴起的过程中在产权归属和产权负担方面都形成了特定的风险,现行的房地产产权交易制度无法保证产权交易的安全性,因此在中国房地产交易市场上,产权信息获取成本较高,普通交易者无法有效地规避产权风险。目前产权保险在国外已经发展成为一项比较成熟的制度,有效地保障了房地产产权交易的安全。产权保险为明晰产权信息、化解产权风险提供一种有效的商业化的运作机制,对解决中国房地产市场的产权风险问题具有重要的借鉴价值和现实意义。
In the rapidly growing process of China's real estate market , special risk was formed on title vesting and title encumbrance. The existing real estate system is unable to ensure the security of title transactions, therefore, the acquiring cost is comparatively high and the ordinary transactor has no way to effectively avoid their risks on China real estate market. At present title insurance has become a well-developed system in the foreign market and offers effective protection to the real estate transaction risks. Title Insurance provides a valid commercial mechanism for transparent information and risk avoidance, and also has great value for reference and practical significance to solve title risk problems in China market.
