摘要
我国厉行法治,从清末沈家本先生算起,已达百年之久。进入21世纪,在建构现代化社会时,西方法律理念在中国仍未落实。本文从社会学的角度出发,将中西双方法律理念相融合与对西方法律的继受看作是一个长期性的社会变迁过程,并分析中西法律理念冲突的成因,希望对探求中国法治之路有所启示。
When Mr. SHEN Jia - ben began to change the legal system in order to seek society ruled by law, it had continued above one hundred years. In the 21st century, when we are constructing the modernized society, the western legal idea and the Chinese traditional legal idea did not blend into each other. Presently, it is abnormal that society rifled by law running. We analyze the conflict between the traditional legal idea in China and the west legal idea from the point of view of sociology, and regard replanting the west legal system as a long term process of the change of our society. We hope that there is enlightenment for the road of the Chinese society ruled by law.
