摘要
本文以追溯学生法庭的历史、界定学生法庭的内涵为切入点,对目前高校设立学生法庭的做法作了利弊分析。认为利在有助于弘扬大学生的自治精神,有利于促进高校的法制建设,有助于构建执法与人文关怀同步发展的和谐社会;弊则存在法律隐患,法庭队伍建设困难,对法庭的管理与监督不易等。针对存在的问题,提出了只在有条件的部分高校尝试建立学生法庭,与模拟法庭合为一体,其职能定位只限于辅助学校处理违规违纪问题的建议。
Basing on the history and the meaning of the students＇ court, the author analyzed the advantages and disadvantages of it . The advantages of students＇ court are to publicize college students＇ self-governing spirit, to promote the universities＇ legal reform and to build a harmonious society under the raw of law. The disadvantages of students＇ court are the existence of legal hidden troubles, difficulties in training the court＇ s members and court＇ s management. Aiming at the problems of the students＇ court, the author suggested that the students＇ court be established at some universities with proper condition, helping universities to deal with students＇ violating rules together with the moot court.
