摘要
鉴于《食品卫生法》调整范围较窄、食品卫生与食品安全的内涵有别等原因,以《食品安全法》替代《食品卫生法》是保障我国食品安全的需要。构思《食品安全法》框架的基本思路应从体制、机制和法制诸方面考虑。还对法律责任和地方立法问题进行了专题探讨。
Because of many reasons, in order to guarantee food safety in our country, it is necessary to replace the Law of Food Hygiene with the Law of Food Safety. To construct the basic frame of the Law of Food Safety must take the social system, mechanism and the legal system for consideration. The subjects of legal liability and local legislation are also explored in this paper.
