摘要
通过分析国有企业改制土地处置不同阶段的法规和实务特点,总结国有企业改制土地处置的监管思路得出这样的启示:国有土地和集体土地两种产权的区别、两个市场的分割造成的效率损失,阻碍了我国市场化进程,农村集体土地制度亟待改革。让农村集体土地进入企业改制主体,成为统一市场流转的对象,必须从完善权属、统一有偿制度、稳定状态和强化信息披露等方面入手,消除国有用地和集体用地的市场分割障碍,最终实现同地同权同价的总目标。
In this essay, characteristics of the status and practices for handling land in different periods of State - owned enterprises (SOE) transformation was analyzed, from which the way of land handling supervision in the process of SOE transformation was summarized. It suggested that as a result of the low efficiency caused by the difference between lands owned by the State and by the collectivity together with the break up of these two markets, our economic reform has been lagged; therefore the land ownership in rural areas needs to be changed. In order to bring lands owned by the collectivity in rural areas into the central part in SOE transformation and enable it to consolidate the market, it suggests that first of all land ownership have to be clarified, second, consolidating the compensation system and stabilizing the market, third, improving the degree of information exposure. By applying all the methods, the break-up between the two markets of lands owned by the State and by the collectivity will be eliminated, and eventually the final goal of same right and same price for the same land will be achieved.
