摘要
“法与金融学”是从20世纪90年代中后期才在美国兴起的一门新兴交叉学科,是继20世纪60年代美国兴起的“法和经济学”运动之后的又一股“法与金融学”交叉研究浪潮,属法律经济学研究的前沿分支领域。本文介绍了这门新兴交叉学科的最新研究程式和研究计划,并用其中蕴涵的“路径依赖”理论来揭示中国金融法变革过程中的制约因素以及该制约条件对主流法与金融法理论的挑战,从而为金融法变革寻找理论基础。
Law and Finance is an emerging interdiscipline, which is developed from the middle of 1990s in America. As a frontier of Law and Economics, it is another wave after the movement of Law and Economics initiated from 1960s in America. The article introduced the up-to-date research program of it, revealing the restriction variety of the reform of the financial law in China by the path dependence theory and the challenge to mainstream theory of Law and Finance, to seek for the theoretical foundation of the change of the financial law. At last, the article reviewed the prospect and the direction of the native study of Law and Finance in China.
