摘要
本文具体分析了我国农村养老的现状和面临问题,指出以家庭养老为主、社会养老为辅是我国目前农村养老保障的主要形式。随着农村人口结构的改变和农村经济的发展,目前的养老形式面临着诸多问题,急需立法予以制度化、规范化。针对我国的具体国情,借鉴国内外相关立法经验,笔者提出了实行农村养老保障单独立法,建立以维持年老农民最低生活水平为目标的农民社会养老制度,进一步完善家庭养老的立法构想。
This paper gives an analysis of the status quo of social security in China＇s countryside and points out that family is the mainstay and society is the complement in the way of social security. According to the status quo of China, the author of this paper puts forward the suggestion that laws should be made to provide old -aged villagers with social security. The lowest life security should be guaranteed to sustain the old peasants so that the idea of making laws for old - aged people supported by family may be improved in a further way.
