摘要
采用文献资料法、调查访问法等研究方法,从法学角度阐述了体育冠名合同与买卖合同、赠与合同、公益事业捐赠合同、广告合同的区别,认为体育冠名合同属于唯一授权许可合同;论述了体育冠名法律保护的不足:冠名权尚未取得合法的法律地位;缺乏调整、规范体育冠名活动的法律、法规;还就完善体育冠名合同的法律保护进行了探索。
With the combination of documentary analysis, interview and so on, in the perspective of law, this research explores the differentiation of naming fight contract and trading contract, donating contract, donating contract of enterprises, and advertising contract. It is regarded that the sports naming contract belong to the single authorized permission contract. Further the shortcomings of the legal protection were summarized as follows: lack of the specific law which regulates and modifies activities of sports naming. This paper also probes into the consummating of law protection of sports naming fight.
