取水权的客体是水资源,是取水地点所在范围内的水资源。取水地点是有特定性的,可以用经线和纬线在地图上标出,可以在地表和水面标示其四至范围。取水地点的特定性决定了取水权客体的特定性。特定取水权的客体指的就是其取水地点所在范围内的水资源。取水权客体虽然在物理形态上不能作为一个独立物,但是它有四至范围,可以登记的方式加以公示,可以以在交易观念上成为独立物。
The object of water right is water resource. The object of a certain water right is the water resource in the range of its water diverting place. Water diverting place can be particular by longitude and latitude in the map. Moreover, water diverting place can be signed on the surface of water and earth. The specific of water right object is reflected by the specific of water diverting place. Water right can be trade as an independent thing for its register.
