摘要
知识产权的行政保护是知识产权保护的途径之一,它的正确实施具有司法保护不具有的独特优势。我国的知识产权法律法规对知识产权的行政保护也作出了规定,实践中行政执法对知识产权保护也发挥着巨大作用,但在知识产权的行政保护方面亦存在许多问题,有待进一步完善。
The administrative protection is one of the approaches to protect the intellctual property right and the proper implement of this protection carries the special superiority that the judicial protection does not have. The laws and regulations of intellectual property right in our country have stipulated the administrative protection concerning the intellectual property right. The administrative enforcement of the law concerned in practice has also played an important role in the protection of the intellectual property right. Yet, there are still some problems in the area mentioned above and the further improvement of the situation,therefore,is in need.
